Please bear with me, this is perhaps grossly simplified to avoid deterring the faint hearted.
Why is it important to confer a fine or civil penalty after a hearing or trial?
Because you can’t unscramble scrambled eggs, (Meet Joe Black).
A whole destiny and life can be altered by simply one incidental cause, like turning left into a speeding car, or back from unseen danger. It’s that easy. Think about how many times in your life, a small incident altered your destiny. The moment when you were looking away, and your three year old disappeared out of sight, The chance moment when you had a meeting with the love of your life, and missed each other, or when you met, and all your life thereafter changed. THAT’s WHY.
Time, the class concept is ALL TIME, has in accord with our present understanding, and within our lives’ compass, type members; even if they are logically almost identical, that are mutually exclusive with the dividing line of the moving present.. The boundaries shown are arbitrary in both shape and size. The two main types members here are incapable of overlapping and only exchange or transfer betwixt, via the moving present.
Events, objects and structures that exist in the past / present cannot, according to our worldly notions that are both efficacious and reliable, exist in both LEFT AND RIGHT ( past & future ) simultaneously but only separated by the present.
There are many members in all parts that share or will share similarities, but those on the left are actualised, and on the right exist only in potentia. The past infects the present and future in accordance with overwhelming forces of destiny that lead us to believe for the most part that occurrences beyond the event horizon on the right side are not subject to the forces of logic, and laws of nature. What is more likely to be the case however is that events whose future horizons are more distant, offer greater choices than those nearer the event horizon of the moving present.
For things in flux according to Heraclitus, (c. 535 - 475 BC) who said you cannot step into the same river twice! The identity of faster changing things alters with time; which is a function of movement, without which there is no sense of time to the thinking entity.
For our purposes we freeze time in pro positional sentences, and step back from the chrono topology of six (past present future, height, length width) dimensions, to simply four dimensions, three of space and ONE of time. The time slice is whatever fixed point in the scale time T1 to time T2.......n is relevant.
Some types of class members are animal, vegetable, mineral and abstractions like events. An animal; like all the others mentioned, will traverse the time sequence altering its identity fractionally in accord with the entity of perception in observation. We are interested only in, ‘trials’ and ‘hearings’, but the principle remains the same.
That all grants and promises of fines and forfeitures of particular persons before conviction are illegal and void;
The original wording is. - And severall Grants and Promises made of Fines and Forfeitures before any Conviction or Judgement against the Persons upon whome the same were to be levyed. All which are utterly directly contrary to the knowne Lawes and Statutes and Freedome of this Realme.
The literal meaning of this sentence is ALL fines and forfeits BEFORE trial are illegal and void.
ALL (F & F ) at T2 are (I & V), where T2 is a point in serial time of a trial that is after the levy of the fine or forfeit.
It is important to note here, that if a penalty is ever levied before a trial or hearing and the trial determines the penalty was unlawful then dire consequences can follow where that penalty was for example total loss of livelihood, imprisonment, bodily harm, eg; cutting off a hand, or death. It might just be a little difficult to remedy the situation, where restitution means restoring the innocent party to their original state before the fine or forfeiture.

EVENTS and their constructions that follow from the operation of a cause and result in consequences.
Take and compare the construction of anything, say a house, or amusement park, anything; a trial or hearing.
The event will have its early stage as a creation from the idea, to the implementation of it. As it commences, it will at any point between its inception and completion have a past present and future,and when complete shall consolidate as a past event with instant but decreasing permanency depending on its life span.. At whatever stage of its construction it cannot exist in the future except as an idea, conjecture or plan. Existence is an attribute or predicate of entities in the present and past only ( where it remains as a concrete object rather than merely a memory of it ). Its impact on the future is as aforementioned merely as an idea that is infected by the past if there is existence in a material form or memory.. While a sentence can be constructed that predicates existence of a future event, it remains undetermined until such event is actualised. Aristotle's paradox of the sea battle in the law of excluded middle;

2. There will not be a sea-battle tomorrow
Suggests that there is logical determinism in the future events, since one of these possibilities has to become a reality. We shall not digress at this stage into paradox
